SECTION 1 - ORDER TERMS

By agreeing to these Terms of Service, you declare that you are at least the age of 18 and you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

1.1 Validity of Contract

By making a purchase from us, you declare that you are at least the age of 18 and have the legal capacity or, in the absence thereof, have the parental authorization enabling you to enter into the contract. If not, in order to settle a possible dispute, we reserve the right to contact the person(s) having the parent care or your deputy directly. We will, therefore, be authorized, but not limited to, to require that the person(s) having the parent care or your deputy settles all orders placed by you.

For other types of agreements, please contact us before completing your purchase. As soon as the order has been placed by you, we will send out a confirmation email to the email address you have provided. It is your responsibility to provide a functioning address and check the order confirmation thoroughly for possible errors. It is important that you contact us immediately in case you wish to change or correct any details in your order. Once the production of a custom-tailored or a custom-made barong has started, no further changes can be applied. Information about the status of your order will be sent to the email address you have provided. As soon as the order has been shipped, a confirmation email containing possible tracking links is sent to your email. Upon the receipt of the goods through the customer, the contract is regarded as concluded.

2.1 Ordering Method

You can place an order through either of the following methods:

Online store - Orders placed through our online store will receive a system-generated order number and automated notifications for all order updates. 

Customer support - For orders requiring personalized assistance beyond our online store's capabilities, our customer support team will provide a detailed quote, including product specifications and fulfillment timelines. An electronic invoice will be issued for order confirmation and payment. Upon confirmation, you will receive a system-generated order number and automated notifications for all order updates. 

2.2 Order

Product images are intended for visual reference only. Natural variations in fabric transparency, lighting, and device display may affect the perceived color and texture. Furthermore, due to the handcrafted nature of our products, variations in fabric, thread, and applied techniques may result in slight differences in construction, texture, and color. Therefore, images serve as a visual guide only and do not represent an exact depiction of the final product. 

2.3 Prices

All prices are quoted in Philippine Pesos (PHP), our domestic currency. While we ensure accuracy, we reserve the right to correct any pricing, typographical, or other errors, and to cancel or refuse to accept any order based on an incorrect price or description. Such corrections or cancellations may be made even after an order is accepted.

2.4 Payment

All payments due shall be made in PHP. Any prices quoted in currencies other than PHP are provided solely for quick conversion and should be considered as indicative rates only. If a payment is made from an account denominated in a currency other than PHP, the actual payment amount is determined by the payment gateway's exchange rate at the time of payment.

To confirm a custom order, we offer the option of full payment or a 50% deposit if the total quote exceeds PHP 20,000 with the remaining balance due upon production completion. For orders  less than this amount or if the time between the quote's validity expiration and the production completion date is less than five weeks, full payment is required. 

Once your order enters the production phase, you will be notified via email. Order modifications after this notification may be accepted or declined based on the specific nature and timing of your request. Cancellation of your order during the production phase will result in the forfeiture of your deposit or 50% of the total payment, whichever is applicable.

The following payment methods are available:

• PayPal. PayPal handles and protects all sensitive credit/debit card information. No extra charges apply.
• Credit or Debit Card. You can also pay through PayPal using your Credit Card or Debit Card without a PayPal account. Just select PayPal in the payment method and click "Complete order." You will be redirected to PayPal to complete your purchase securely. On the PayPal page, select "Pay with debit or credit card." If PayPal does not allow your country of residence to ship to the country you wish to, please try a different payment method.
• Bank Transfer (Online or Over-the-Counter). The payment instructions will be provided to you after completing the checkout process.

2.5 Shipping

Our products have unique characteristics, and making them is time-consuming. Hand-embroidered pieces, in particular, require a significant amount of time to be made. Hence, we only ship using express courier services to guarantee faster and more secure delivery of goods. This method allows us to deliver products to domestic destinations in one to seven (1-7) business days and to international destinations in three to five (3-5) business days.

Shipping across the Philippines is FREE on orders over PHP 5,000. For overseas shipping, the cost depends on the quantity, pouch or box size, weight, declared value, and destination country. A package of one barong has a shipping cost ranging from PHP 1,400-4,000. A package of five barongs has a shipping cost ranging from PHP 4,800-8,300. A package of more than five barongs has a shipping cost ranging from PHP 8,300-22,500.

You will receive an email with a tracking number as soon as your order is processed for shipment.

When importing goods, the destination country imposes customs duties and taxes if the value of the goods surpasses the minimum threshold (known as the de minimis value) it has established.. You are responsible for paying any inbound charges which your local customs authority deems appropriate. To find the de minimis value by country, please visit https://www.trade.gov/de-minimis-value. Customs policies and import duties vary widely from country to country so it would be a good idea to contact your local customs office for information. If customs duties are to be paid, the courier will inform you ahead of the delivery.

2.6 Delivery

Domestic - Delivery is within 1-7 business days of shipping depending on location within the Philippines. 

International - Delivery is within 3-5 business days of shipping.

These estimates are based on average shipping times from Lumban, Laguna, Philippines. The actual delivery date is not guaranteed and may vary.

2.7 Right of Withdrawal

You have the right to reject your ready-made products purchased from us. In case of withdrawal, please send us an email to support@heritagebarong.com. The right of refusal is valid only if the items are returned in an unaltered state within seven (7) days from the day the goods are received.

Due to the personalized nature of custom-made orders, all purchases are final. Refunds and returns are not permitted, except in the event that we fail to deliver the product in accordance with the agreed-upon specifications. In such instances, we may, at our discretion, offer alterations, remakes, or a partial refund. Please note that natural variations in materials, embroidery, and craftsmanship are inherent to handmade products and do not constitute defects.

We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We have identified the specific measurement figures and photos that we require from our customers to make sure that our products will fit properly. While we do our best to determine the proper measurement using the information that a customer provides, we are not responsible for any ill-fitting products resulting from the submission of incomplete requirements or from the submission of requirements that do not follow our instructions and the manner they are illustrated. If your measurement figures and photos are incomplete or not aligned with our instructions and illustrations, we will let you know so you will have the opportunity to correct and complete them.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
